These Terms of Service ("Terms") govern your access to and use of the pawganix.com website (the "Site") and the purchase of products from Pawganix LLC ("Pawganix," "we," "us," or "our"). By accessing or using the Site or making a purchase, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Products & Supplement Disclaimer

Pawganix products are dietary supplements for pets. They are not intended to diagnose, treat, cure, or prevent any disease. Statements about our products have not been evaluated by the Food and Drug Administration (FDA). Our products are manufactured in FDA-registered, cGMP-certified facilities and comply with AAFCO model regulations for animal supplements.

Always consult your veterinarian before starting any new supplement regimen for your pet, especially if your pet is pregnant, nursing, taking medication, or has a known health condition. Individual results may vary.

2. Account Registration

You may create an account to access certain features (order history, subscription management, rewards program, pet profiles). You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete information when creating your account and keep it updated. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Purchases & Pricing

All prices are listed in US Dollars and are subject to change without notice. We reserve the right to refuse or cancel orders at our discretion, including in cases of pricing errors, suspected fraud, or product unavailability. If an order is canceled after payment, we will issue a full refund.

Payment is processed at the time of order placement. We accept major credit cards, debit cards, and other payment methods as displayed at checkout. Payment processing is handled by our third-party payment processor, and we do not store full credit card information.

4. Subscribe & Save

By selecting Subscribe & Save, you authorize us to charge your payment method on a recurring basis at the frequency you selected. You may skip, pause, change, or cancel your subscription at any time through your account dashboard. Changes take effect on your next billing cycle. If a recurring charge fails, we will attempt to process the payment up to three times before pausing your subscription. We will notify you by email of any payment issues.

5. Shipping & Delivery

Shipping timelines and rates are described on our Shipping & Returns page. We are not responsible for delays caused by shipping carriers, weather, natural disasters, or other circumstances beyond our control. Risk of loss and title for products pass to you upon delivery to the shipping carrier.

6. Returns, Refunds & Money-Back Guarantee

Our return and refund policies, including our money-back guarantee terms, are described on our Shipping & Returns page and are incorporated into these Terms by reference. Guarantee timeframes begin on the date of purchase (or the date of original subscription order for S&S products).

7. Pawganix Rewards Program

Participation in the Pawganix Rewards loyalty and referral programs is subject to the program rules described on our Rewards page. We reserve the right to modify, suspend, or terminate the rewards program at any time with reasonable notice. Points have no cash value and cannot be transferred or sold. We reserve the right to deduct points earned through fraudulent activity, including self-referrals and fabricated reviews.

8. Ambassador Program

The Pawganix Pro Ambassador Program is subject to separate terms provided upon enrollment. Ambassadors are independent contractors, not employees of Pawganix. Ambassador commissions are earned only on qualifying sales and are paid according to the program terms. We reserve the right to modify commission rates or program terms with reasonable notice.

9. Intellectual Property

All content on the Site — including text, images, logos, product names, designs, and software — is the property of Pawganix LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. "Pawganix," "YeastGuard," "MoveGuard," "SteadyGuard," "BiomeGuard," and related names and logos are trademarks of Pawganix LLC. You may not use, reproduce, modify, or distribute our content without prior written permission.

10. User Content

By submitting content to our Site (reviews, photos, quiz responses, ambassador applications), you grant Pawganix a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, and display that content in connection with our business, including on our website, social media channels, and marketing materials. You represent that you own the content you submit and that it does not infringe on the rights of any third party.

11. Prohibited Uses

You agree not to:

• Use the Site for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Site or its systems
• Use automated tools (bots, scrapers) to access the Site without our permission
• Submit false or misleading information, including fake reviews
• Abuse the rewards or referral programs through self-referrals, fake accounts, or other manipulation
• Resell Pawganix products without authorization

12. Limitation of Liability

To the fullest extent permitted by law, Pawganix and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products. Our total liability for any claim related to our products or services shall not exceed the amount you paid for the specific product or service at issue.

13. Indemnification

You agree to indemnify, defend, and hold harmless Pawganix and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved through binding arbitration in Sheridan County, Wyoming, except that either party may seek injunctive relief in court for intellectual property violations or other equitable claims.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a revised "last updated" date. Your continued use of the Site after changes constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
